Terms of Service

1. Service Overview

Buy it Bot is an AI shopping and gifting agent. You can purchase products for yourself or generate gifting experiences for others. We are not the merchant of record. Purchases are completed with third-party merchants (e.g., Amazon, Shopify stores). Any product quality, shipping, or warranty matters are the merchant’s responsibility.

Our first-party Shopify storefront is hosted at shop.buyit.bot. All current fulfillment is limited to United States shipping addresses.

2. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract. If you create an account, you are responsible for maintaining its security and for all activity under it.

Accounts can be created by linking an OAuth provider (Google, Twitter), connecting a wallet, or redeeming a gift sent to an ENS/Farcaster/Twitter handle. By authenticating you consent to us storing the minimal provider identifiers required to operate the central identity graph (e.g., normalized usernames, wallet addresses, OAuth tokens).

3. Third-Party Platforms

Our Services integrate with third-party platforms, including Amazon and Shopify. Your use of those platforms is subject to their terms and policies. We are not responsible for third-party services.

4. Orders, Gifts & Redemptions

You are responsible for the accuracy of recipient details, shipping addresses, and product selections. Gifts may be subject to availability, merchant inventory, and geographic restrictions. If an item is unavailable at fulfillment, we may cancel the order or substitute an equivalent item at our discretion or the merchant's discretion.

Gifts sent to usernames/handles (e.g., ENS, Farcaster, Twitter/X) are delivered based on our identity graph. If multiple candidates exist for a handle, we may require additional verification before fulfillment. Unredeemed gifts may be canceled or refunded at our discretion after a reasonable period.

5. Fees and Refunds

We may charge service fees for facilitating gifting workflows. Fees are disclosed at the time of use and are generally non-refundable once a transaction is initiated, except where required by law or expressly stated otherwise. Refunds and returns for products are subject to the merchant's policies.

6. Acceptable Use

You agree not to misuse the Services, including by violating laws, infringing intellectual property, scraping without permission, or interfering with the operation or security of the Services.

7. Payment Processing and Prohibited Items

We partner with Stripe for payment processing on first-party products from our Bea's Bazaar storefront. By using our Services, you agree to comply with Stripe's terms and policies, including their Restricted Businesses List.

For third-party merchant products (Amazon, external Shopify stores), we use cryptocurrency-based payment processing (USDC on Base blockchain) which does not involve Stripe.

Prohibited Items: You may not use our Services to purchase or gift products that:

• Contain sexual, violent, or hateful content
• Promote self-harm or illegal activity
• Violate Stripe's Restricted Businesses policy
• Infringe intellectual property rights
• Are otherwise prohibited by law or payment processor policies

We use automated content moderation to screen all gift purchases. Violations may result in transaction rejection and account suspension.

8. Digital Assets & On‑Chain Transactions

Some features use blockchain networks (e.g., USDC on Base). On-chain transactions are irreversible, may incur network (gas) fees, and are publicly viewable. You are responsible for safeguarding your wallet credentials and verifying transaction details before submission. We are not responsible for network congestion, forks, chain reorgs, smart contract bugs, or failures of third-party wallets or bridges.

We do not provide investment, legal, or tax advice. Prices and availability of digital assets and goods may be volatile or change without notice.

9. AI Output and Accuracy

AI-generated content may be incomplete or incorrect. You are responsible for verifying information before making decisions or purchases.

10. Privacy

We handle personal information in accordance with our Privacy Policy. Shipping details for recipients are encrypted in transit and at rest. Identity handles (wallets, ENS names, OAuth provider IDs) are stored so we can deliver gifts to the intended person; you may request removal at any time.

11. Intellectual Property; License; Feedback

The Services, including software, text, graphics, logos, and trademarks, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use.

If you provide feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback without restriction or compensation.

12. User Content

You are responsible for content you submit (e.g., chat prompts, messages, gift notes) and represent that you have the necessary rights to submit it. You grant us a non-exclusive license to use that content solely to operate and improve the Services. Do not submit content that is unlawful, infringing, or violates these Terms.

13. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not warrant uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special, or exemplary damages. Our aggregate liability shall not exceed the fees you paid to us, if any, in the twelve (12) months preceding the claim.

15. Indemnification

You will indemnify and hold Utility Fueled LLC, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to your use of the Services, your content, or your violation of these Terms or applicable law.

16. Termination

We may suspend or terminate access to the Services at any time with or without cause, including for violating these Terms. Upon termination, provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification, arbitration) will survive.

17. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles, except where preempted by applicable federal law.

18. Dispute Resolution; Arbitration; Class Action Waiver

You and Utility Fueled LLC agree to resolve any disputes arising out of or relating to these Terms or the Services through final and binding arbitration administered by JAMS under its rules, on an individual basis only, and not as a class action or class arbitration. The Federal Arbitration Act and federal arbitration law apply. You waive any right to a jury trial or to participate in a class action. You may seek relief in small claims court if eligible.

19. Export Controls & Sanctions

You may not use the Services if you are, or are acting on behalf of, a person or entity subject to sanctions, or in violation of export control laws and regulations. You are responsible for compliance with all applicable export and sanctions laws.

20. Force Majeure

We will not be liable for delays or failures to perform resulting from events beyond our reasonable control, including acts of God, labor disputes, internet failures, power outages, third-party service interruptions, or changes in law.

21. Third‑Party Links

The Services may contain links to third-party sites or services. We are not responsible for their content or policies.

22. Changes to the Services and Terms

We may modify or discontinue all or part of the Services at any time. We may update these Terms from time to time, and changes are effective upon posting. Continued use of the Services constitutes acceptance of the updated Terms.

23. Electronic Communications

You consent to receive communications from us electronically and agree that all terms and notices we provide electronically satisfy any legal requirement that such communications be in writing.

24. Assignment; Severability; No Waiver

You may not assign these Terms without our prior written consent. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.

25. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Services and supersede prior agreements on the same subject. Headings are for convenience only.

11. Changes

We may update these Terms from time to time. Changes are effective upon posting. Continued use of the Services constitutes acceptance of the updated Terms.
